Manufacturers of technical devices tend not to observe this provision and mainly offer one-year warranties for their products, sometimes with the option of paying extra to extend the warranty for two years or more. In some cases, buyers can also pay a surcharge to cover them for any mechanical damage that they might do to a product, but this functions merely as additional insurance and a supplement to the warranty. More often than not, the above provision is not enforced, since makers and sellers pass the buck to each other and manufacturers, for the most part, do not observe the two-year warranty requirement. It is not even unusual for the same manufacturer to offer warranties of different durations for the same products, depending on the Member State where the products are sold.
"Consumers are the ones who suffer because of this situation. It's up to us to protect consumers and provide them with equality in the common market" - pointed out Picula in his letter to the Commission, after numerous e-mails that his Office received from citizens.
